DataFlow Analytics Sp. z o.o. provides a range of IT services, including but not limited to WhatsApp Business API integration, communication channel data extraction, business process optimization, data analysis and reporting, custom dashboard development, CRM/ERP system integration, and data security consulting. The specific services provided to you will be outlined in a separate agreement or statement of work.

Our online platform and services may involve accessing, processing, and presenting data. You are responsible for the legality, accuracy, and completeness of any data you provide or allow us to access.

3. User Obligations

As a user of our services or platform, you agree to:

• Comply with all applicable laws and regulations regarding your use of our services, including data privacy laws.
• Provide accurate and complete information when required.
• Maintain the confidentiality of any account credentials or access tokens provided to you.
• Not use our services for any illegal or unauthorized purpose.
• Not interfere with or disrupt the integrity or performance of our platform or services.
• Ensure that you have the necessary rights and permissions to provide us with access to any data or systems required for the provision of services.

4. Intellectual Property

All intellectual property rights in our online platform, underlying technology, and any pre-existing materials provided by DataFlow Analytics Sp. z o.o. remain the property of DataFlow Analytics Sp. z o.o. or its licensors.

Any custom developments, reports, dashboards, or other deliverables created specifically for you under a separate agreement may be subject to specific intellectual property terms defined within that agreement.

5. Data Handling and Privacy

Our services involve the handling and processing of data. We commit to handling your data in accordance with applicable data protection laws, including the General Data Protection Regulation (GDPR) if applicable, and our Privacy Policy.

You are responsible for ensuring that your use of our services, including the data you provide or allow us to process, complies with your obligations under applicable data protection laws, including obtaining necessary consents and providing required notices to data subjects.

For services involving data extraction or integration with third-party platforms like WhatsApp Business API, you acknowledge that such services are subject to the terms and policies of those third parties, and you are responsible for complying with them.

6. Limitation of Liability

To the maximum extent permitted by law, DataFlow Analytics Sp. z o.o. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of or inability to access or use our services; (b) any conduct or content of any third party on our services; (c) any content obtained from our services; and (d) unauthorized access, use or alteration of your transmissions or content.

Our total aggregate liability to you for any and all claims arising out of or relating to these Terms or your use of the services, regardless of the form of action or claim (e.g., contract, tort, strict liability, or otherwise), will be limited to the amount paid by you to DataFlow Analytics Sp. z o.o. for the specific services giving rise to the claim in the twelve (12) months preceding the claim.

7. Termination

We may terminate or suspend your access to our online platform or services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms and Conditions.

All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

8. Governing Law and Jurisdiction

These Terms and Conditions shall be governed and construed in accordance with the laws of Poland.

Any disputes arising out of or in connection with these Terms and Conditions shall be subject to the exclusive jurisdiction of the courts in Warsaw, Poland.
